Shepard Fairey Sues the Associated Press

In the latest installment of the closest thing the poster world has to a soap opera, Shepard Fairey has decided to sue the Associated Press over their accusation of copyright infringement.  Shepard claims his artwork fell under the Fair Use statute, just as we all predicted.  Basically, all the AP is doing is giving Shepard a TON more publicity, something I didn’t even think was possible.  This one is being featured on all the major news sources, but I’ve been reading about it at Bloomberg.com.

  1. Truer words have never been spoken. your right on with the soap opera and publicity. Does anyone know if this is the first time an accusation like this has went to court? Its a Gray area in lots of peoples and designers minds for sure.

  2. Hey admin, Can I speak my mind? I think this is a b**ch move on Shepard’s part. You know his greedy lawyers are behind this. He has totally lost all remianing street cred what was left. It is the same as snitching. This is way over the top

  5. His lawyers are taking the case purely to argue an area of law they specialize in . . . Fair Use.
    “Mr. Fairey’s lawyers, including Anthony T. Falzone, the executive director of the Fair Use Project and a law lecturer at Stanford University . . . ”
    I bet his lawyers LOVE him for creating something so big and popular they can make their careers defending him.
    And, if they win then all Shepard Fairey ‘Art’ is going to to be considered Fair Use because he puts it up in public places. Be careful what you wish for Mr. Fairey.

  7. Why hasn’t anybody mentioned his pathetic arrest? A 38 year old still vandalising the walls. He can afford to buy buy space like he does here in Los Angeles

    he was arrested doing what he loves and will continue taking such risks because it is a part of him. have you ever felt passionate about something chuck?

    It will be interesting to see if Fairey uses the same “excuse” should the remit of this lawsuit widen to include earlier works…

    The fact that Fairey has been labeling recent prints that utilize “found” imagery as “collaborations” with the original photographer, is suggestive of the fact , that maybe, there has been more ‘behind the scenes” discussion of this aspect of his work than has previously been publicly acknowledged

    Legality aside, I’m still a Shepard Fairey fan.
